NEW LANDLORD TENANT LAWS IN NEW YORK MAKE MATTERS WORSE FOR TENANTS

New York State has taken the position tenants need additional protection. New laws were intentionally designed to prolong evicting a tenant, any tenant.

If they reside on the property less than a year, they must have 30 days’ notice you are evicting, one year but less than 2 years, 60 days’ notice, two years or more, 90 days’ notice.

What happens when the tenant is violent, disturbing other tenants, or involved with illegal activity? The landlord’s – property manager’s hands are tied. Waiting to go before a judge, then discovering by law the tenant is allowed two additional weeks before going back to court. If the eviction is successful, two more weeks before law enforcement can remove the tenant from the property. And, however long it takes when law enforcement can get around to it.

Do you suppose individuals who will do drive by shootings or involved in drug activity are the perfect tenant -neighbor ? The law states tenants should reside in a safe environment. That is not possible with these new laws. Law abiding tenants who have leases will be forced to deal with the situation. Does this really help tenants?

These new laws have forced landlords – property managers to be very selective who can rent an apartment. Renting to the wrong tenant is a costly error. So, how exactly does this assist tenants when it has become more difficult to rent a good apartment?

It is recognized that no one wants to see individuals homeless. Individuals who create drama, torment other tenants, or promote an unpleasant environment for others are protected for months before a landlord-property manager can correct the situation. Certain situations that involve violence should not have the same tenant protection as a struggling mom trying to make ends meet.

If you are a tenant in New York State you are protected from fast evictions however, if you end up with a neighbor who is a nightmare, you will deal with it for however long it takes for the landlord-property manager to evict the tenant so you may safely enjoy your apartment. Like Bail Reform, this law was not well-thought out. Having a lease you cannot break and being forced to reside in a potentially dangerous environment due to an unruly neighbor assists no one.
